COMMOTTE DE KIDWELLY WELSHRY
The Presentmente of the Jurye for the Welshry of the Commotte of Kydwelly made the nynth daye of October anno regni Jacobi nunc Regis Anglie etc. septimo et Scotie quadragesimo tertio at Landebea to certaine Artickles given them in chardge by Gerrard Bromley Esquior, generall Survayor of his Majesties Dutchye of Lancaster for the south parts.

Inprimis to the firste Artickle the sayd Jurors doe Answere and saye that they are not able to sett downe the quantitye qualitye and yearely valwe of everye tenemente within theire Chardge and what Estate everye tenaunte standeth seised or otherwyse then shalbe sett downe in the fyfte Artickle.
Item to the seconde Artickle, the sayd Jurors doe presente that the severall boundaryes, lymitts, mearestones and perambulations of the sayd Commotte begynneth on the south parte thereof att the ffalle of the Brooke called Dulais into the arme of the sea called Burrye. And soe goeth westeward a longe the sea syde untyll it meeteth with the ryver called Towye. The which river of Towye boundeth and meareth the same Commotte on the weaste and north syde untill it commeth to the southweste ende of the dytche of a parcell of meadowe grownd which lyeth beneath the brydge of Carmarthen on the south syde of the sayd river which meadowe is taken to be parcell of the lordshipp of Llynllwch, nowe or late in the tenure and occupation of one Thomas Parry, Esquior. And soe a longe the sayd dytche untill it commeth to the south ende of the sayd brydge, and from the sayd brydge alonge the sayd rivir by Auntyent Course untill it commeth to a place called Rydydwarchen, savinge one parcell of meadowe in the hands of Phillipp Vaughan, gent, which lyeth above the sayd brydge beinge parcell of the sayd lordshipp of Llynllwch as the sayd Phillipe Vaughan alleadgeth. At which place called Rydydwarchen the commotte of Iskennen beinge one other parte of the sayd Lordshipp of Kydwellye meeteth and joyneth with the sayd commotte of Kydwellye. And further the sayd Jurors saye that there is one meadowe called the Iland Vawre on the north syde of the mayne ryver of Towye adioyninge to the lands of the Lordshipp of Llangain on the weste. The ffranchises of the County Burrowgh of Carmarthen on the north, the sayd river of Towye on the easte and south parte thereof, the which iland is houlden from his Majestie as in righte of his Highnes sayd Dutchye and beinge part and parcell of the sayd lordshipp of Kydwellye. And the sayd Jurors likewyse saye that there is sundry parcells of his Majesties Lordshipp of Whidygatte and Elvett on the south syde of the foresayd river of Towye att a place called the Iland of Kystannocke contayninge smalle quantityes commonly called yr ynys ycha, which parcells are intermyngled and dispersed in and amonge the Dutchye lands within the same Iland. And that there is two parcells contayninge by estymacion two Englyshe Acres beyond and on the north syde of the sayd ryver of Towye joininge and abuttinge on the Lordshipp of Carmarthen and Abergwylly, the which parcells are taken to be parte of the sayd Lordshipp of Kydwelly and the Commotte of Kydwelly aforesayd abutteth on the easte parte uppon the Commotte of Iskennen and Carnowllan, the which Commottes are parte and parcell of the foresayd Lordshipp of Kydwelly.
Item to the third, the sayd Jurors saye that they doe not knowe of any castlls, mannors or mansyon howses that his Majestie hath within the Welshrye of the sayd Commotte of Kydwellye.
Item to the fowrth, the sayd Jurors saye that they doe not knowe of any demeane lands belonging or apperteyninge to any of his Majesties castles or mansyon howses within theire chardge of the Welshrye savinge some smale quantitye of his Majesties woode called the Wenalte the which wood is nowe in the tenure and occupation of one Morris Bowen, Esquior, by a graunte from the sayd Phillip Vaughan, as the sayd Phillip Vaughan affirmed to the sayd Jurors.
Item to the fyfte, the sayd Jurors saye that they doe presente in a scedule hereunto annexed, the names and surnames of all the ffreehoulders within the Welshrye of the sayd Comotte of Kydwellye to theire knowledge and what rente and Commorth are dwe to his Majestie uppon the sayd ffreehoulders in respecte of theire lands and tenure. And the sayd Jurors further saye and presente that the sayd ffreehoulders and everye of them and all those whose estate they or any of them have had or have, doe hould and have houlden theire lands, tenements and hereditaments from his Majestie and his Highnes auncestors, tyme out of mynde and memory of man in free soccadge to them and theire severall heires and assignes as in righte of his Highnes sayd Dutchye of Lancaster and Honor of Kydwelly, by payinge to his Majestie yearely the some of xxiiiili xiiis iiid ob. and in the name of Cheiffe Rente due and payable at everye ffeaste of Phillipp and Jacobb thappostle and St. Mychaell Tharchanngell yearely. And alsoe by payinge the some of xiiiili vid ob. quad. for and in the name of Magna Commortha et Parva Commortha payable to his Highnes everye third yeare at the ffeasts afforesayd. And likewyse by painge the some of xiili for and in the name of Kysett payable at everye feaste of Phillipp and Jacobb thappostle yearely, dwe as well uppon the sayd ffreehoulders as tenaunts and resiants, which Cheiffe Rente md Commorth is particularly recited uppon the sayd ffrehoulders, as neare as the sayd Jurors can truly sett downe the same as uppon theire severall names it doth appeare. And for the sayd Kysett it cannot be particularly sett downe uppon theire severall names, for that the same are payd as well by the sayd ffreehoulders as by theire tenaunts. And the sayd Jurors further saye and presente that the sayd ffreehoulders and everye of them are bounde to doe to his Majestie suche services, dutyes and customes in generall as hereafter followeth, viz., Et quod faciet sectam curie domini Regis de Kydwelly predicte de mense in mensem et quilibet liber tenens post obitum suum dabit domino Regi decem solidos nomine Heriote et si liber tenens maritaverit filiam suam dabit domino Regi decem solidos nomine Lotherwitt. And the said Jurors saye that there is due to his Majestie the some ot tenn shillings for Alyenacion when a freehoulder doth absolutely sell all his estate of ffreehoulde within the three commottes of the sayd Lordship of Kydwelly to his Majesties farmor of the sayd Lordship. Et quilibet liber tenens faciet stagnum molendin[orum] domini Regis infra commottam predictam exceptis libere tenentibus infra Mannor Cadwgan et excepto uno molendino vocato Melyn Goeg infra parochiam de Llangindeirne cui non est nec fuit ullus tenens consuetus facere ulla officia nec servicia de jure consueta pro ulla reappar (?reparatione) his Juratoribus sumptibus suis propriis et cariabit meremium et molares ad molendina predicta cum necesse fuerit et faciet sectam ad dicta molendina sed tenentes predictorum molendinorum non tenentur solvere propter grossa meremia, molares, virgas et cletheras aut alia necessaria et ad molendina predicta spectantia. For further explanation of the severall services, dutyes and customes afforesayd, the sayd Jurors saye and presente that the sayd ffreehoulders within the sayd Commotte of Kydwellye doe owe theire Suite and Services at two Leete Courts to be houlden for and within the sayd Commotte of Kydwellye befor the St[e]ward of the sayd lordshipp of Kydwellye for the tyme beinge yearely at Maye and Mychelmas and afterwards from moneth to moneth. And everye ffreehoulder after his death shall give to his Majestie tenn shillings for and in the name of a Heryotte in full dischardge for all his ffreehoulde within the Welshrye of the three commottes of the sayd Lordship of Kydwellye for the same. And if a ffreehoulder doe hestowe or give his daughter in maryadge hee shall give to his Majestie the some of tenn shillings for and in the name of a Lotherwitt, uppon the firste maryadge of his daughter in full dischardge for all his lands within the Lordship of Kydwellye and the three Commottes aforesayd. And allsoe for suite of mylles the sayd Jurors saye that the ffreehoulders within Mannor Gonnor are bounde and doe owe theire suite and services to the twoe mylles of his Majestic called Pibour Mylle and Tryscyrch Mille. And all the ffreehoulders within Mannor Iskoed Moris which dwell within the Welshrye doe owe theire suite and services to his Majesties milles called Morleis Mylle and Cwme Mylle, and that all the ffreehoulders within Manner Penryn are bounde and doe owe theire suite and services to the two mylles of his Majestie called Archeddy mille in manner and fforme aforesayd. And the sayd Jurors farther saye that the sayd ffreehoulders are not bounde to doe any services or feche any caryadge touchinge the mylles aforesayd owte of the sayd commotte and if any defaulte be made in the services and customes aforesayd by the sayd ffreehoulders towchingc the sayd mylles, the sayd ffreehoulders are to be presente before the steward of the sayd Lordship and to be by him amerced and noe wheare else. And the sayd Jurors likewyse saye and presente that the foresayd Cheife Rente, Commorth and Kysett ought to be gathered by the Beadle of the sayd Commotte or his Deputy suffitiently authorysed and that his Majestic have and doe alowe for ffee to the sayd Beadle for the same, the some of ffowre Pounds, sixe shillings and five pence or theare abowts within the sayd Commotte. And the sayd jurors saye that the ffreehoulders of everye severall Mannor, ought to appointe Millers for the sayd mylles and that there is dwe to the sayd Myllers, the fowrth dyshefull of all the Corne that shalbe taken for towle within everye of the sayd mylles from the farmours of the sayd mylles. And the sayd Jurors saye that there is the Lordship of Penbrey, the Lordship of Cligyn and alsoe certaine lands called St Johns Lands which lyeth within the parishe of Llangindeirne.
Item to the sixte, the sayd Jurors saye that they doe not knowe of any estate for terme of yeares or lives by Custome or Copyehould estate, either of inheritance or for lives at the will of the Lord or what messuages, lands, tenements or hereditaments they severally hould within the premisses but what is aunsweared in the firste Artickle.
Item to the seaventh, the sayd Jurors saye that they doe not knowe of any ffynes poste mortem or alyenatiouns or what greate somes or other ffynes have byne yearely payd in respecte of the premysses but what is already declared in the former Artickles.
Item to the eighte, the sayd Jurors saye that Sir John Vaughan, Knight, is tenaunte to his Majestic of certayne lands called Terre Sir Rees, et Terre Richard Morris, whoe hath demysed the same or the moste parte thereof for twentye and one yeares to under tenaunts, but what ffynes they paye for the same, they sayd Juerors are ignorante, savinge that the sayd Sir John Vaughan receaved of ffyne of one Rowland Lloyd, gent. the some of Sixteene Pownds, thirteene shillings and fowre pence for three tenements of the sayd lands att the yearely rente of fowrteene shillings for the tearme of twentye and one yeares. And alsoe John Lloyd, gent. payd ffyfteene Pownds ffyne for one tenement and certayne parcells of the sayd lands to the sayd Sir John Vaughan at the yearely rente of tenn shillings and eight pence duringe the tearme aforesayd. And likewyse Ffrauncis Donn, gent. payd to the sayd Sir John Vaughan, the some of eighteene pownds for two tenements at the yearely rente of twentye shillings duringe the terme of twenty and one yeares.
Item to the nynth, the sayd Jurors saye that they doe not knowe of any fforrests, parkes or chaces his Majestie nowe hath or heretofore hath had to theire knowledge within theire chardge, savinge one parcell of land called Cligyn, beinge parcell of his Majesties Lordship of Cligyn, nor doe not knowe of any fforrestes by the names in the sayd Artickle named, or by any other name to his Majestie, within theire chardge, but they hard saye that therr was a forreste called forreste Penryn which is drowned with the sea and further cannot answeare.
Item to the tenth, the sayd Jurors doe presente that there is within Mannor Gonnor three Commons or Mountaynes, viz., the fyrste called Mynith Kyvorth which was knowne and called by the name of Mynith Ycha, and Mynith Issa, which Mynith Ycha lyeth within the Commotte of Iskennen and not within theire charge. The second called Mynith Kerrige, the Thirde called Gwayne Ryvelwyd, lyinge and abuttinge at the severall places and betweene the meares, bounds and lymitts hereafter mencouned, viz., the sayd Commons called Mynith Kyvorth, Mynith Issa lyeth within the parishe of Llangonnor and abutteth easteward uppon the lands of Lewis Willim Howell and from the sayd lands sowthward to the Lordship of Clygine and from the sayd Lordship westeward to a greate stone called Maen y Klicket which stone lyeth neare the lands of Henry Donnlee, Esquior, and there hence towards the lands of Alban Stepney, Esquior, and the waye leadinge from Carmarthen towards Chappell Jeuan on the northe untill it meeteth with the lands called Havot Robert, and from the sayd lands to the lands of the sayd Lewis Willim Howell; the which Commons have byne used tyme out ot mynde and memory of man by the inhabitants of the sayd Mannor wherein and where uppon they and those whose estate they have have depastured with all mannor of Cattell sands number. And the sayd Commons called Mynith y Kerige lyeth within the parishe of LIangandeirne and abutteth easteward at a place there called Ryd y Dadle, the lands of the sayd Alban Stepney, Ffraunces Lewis and others on the south, the gate called Llidiad Pen y Tallwrn on the weste, the lands of the sayd Alban Stepney, Ffraunces Lewis and late of Owen Morgan Richard Reade and the lands of the sayd Ffraunces Lewis, John Griffith, Thomas John, David Lloyd and others on the north parte, which commons have byne depastured and used with all mannor of cattell, sands number, by the inhabitants of the sayd Mannor, dwellinge and inhabitinge within Quarter Tryskyrch, wherein and whereuppon they and those whose estate they have, putt there all manner of cattell sands number, to depasture. The sayd commons called Gwayn Ryw Lwyd, lyeth within the sayd parishe of Llangonnor, the kings Majesties lands, David Willyam Reades lands and others on the easte and south, the lands of Thomas David Rees and others on the weste, the lands late of Thomas Phillippes, gent. deceased and others on the north, apperteyninge to the ffreehoulders adioyningc to the same Commons. And the sayd jurors saye and presente that there is one Marshe lyinge within the parishe of Llangonnor aforesayd commonly called Morva Pen y Sarne contayninge by estymacion ffyftye acres. And abutteth easteward uppon the Causey which leadeth from the south ende of the Brydge of Carmarthen to a place there called The Sarnes, and the kinges Majesties highwaye that leadeth from the sayd Sarnes end towards a place called Pybour, and other lands on the south syde of the sayd ryver of Towy on the weste. And a parcell of meadowe grownd nowe or late in the tenure and occupacion of one Thomas Parry, Esquior, which is alleged to be parcell of the sayd Lordship of Llynllwch on the north, the which Commons hath byne takin and reputed to be parte and parcell of the sayd Lordship of Kydwelly and Dutchyc of Lancaster, and hath byne depastured by the inhabitants of the sayd Lordship of Kydwellye tyme owte of mynde and memorye of man with all manner of cattell, sands number, at all tymes without gaine sainge of any person or persons. And alsoe the sayd Jurors saye that it was proved by fowre wittnesses before them that the Beadells of the sayd Lordshipp of Kydwellye have used theire office uppon the sayd Commons by arestinge of Cattell and makinge executions. And the Cor[o]ner of the Lybertye of Kydwelly have used to execute his office of Coroner uppon all suche persons as shoulde be fownd drowned uppon the sayd Commons on the south syde of the sayd Ryver of Towy tyme owte of mynde and memorye of man. And that the Baylieffes of the towne ot Kydwellyc did and doe use to take Toulle uppon the Causey which lyeth southward of the sowth end of the sayd Bridge of Carmarthen. And they sayd Jurors doe further save that the inhabitants of the towne and nowe Countye Burrowge of Carmarthen have byne likewyse suffered to common uppon the same Commons with all manner of cattell, sands number, but by what tytle they doe not knowe. And they sayd Jurors likewyse saye that they hard that there was a parcell of the sayd Commons allotted and the yearely proffitte thereof as wage to a heard for guidinge of the Commoners cattell, sythence which tyme the Maior and townsmen of Carmarthen have taken the same parcell and the proffitte thereof to theire owne use withowt the consent of the tenauntes and inhabitants of the sayd Lordship of Kydwelly. And moreover, the sayd Jurors doe presente that aboute seaven yeares laste paste one Willim Thomas beinge then Maior of the sayd towne of Carmarthen hath caused and procured all the reste of the sayd Commons to be enclosed and taken awaye violently with force from the sayd Commoners of the Lordshipp of Kydwelly aforesayd that the same is continually ever sythence kept by the Maior of the sayd towne not withowte the contynuall gayne sayinge of the inhabitants of the sayd Lordshipp. And the sayd Jurors doe presentte that there is one Common within Mannor Penryn in the parishe of Penbrey called Mynith y Garn Vawre, apperteyninge to the tenaunts of the sayd Mannor wherein and whereuppon they and those whose estate they have, have depastured with all manner of cattell, sands number, at all tymes. And the sayd Jurors sayd that his Majestie is seised of certaine lands called Tyre David Goch scituat and lyinge within the sayd parishe of Penbrey and Mannor Penryn reddittus per annum eighte shillings and sixepence halfe pennye, which rente is dwe and hath byne accompted as parte and parcell of the some of five pownds fowre shillings and penny halfepenny due to his Majestie of Cheife Rente within the sayd Mannor and occupied by the tenaunts adioyninge to it and payd yearely to the Beadle of the sayd Mannor of Penryn. There is alsoe one other parcell of lands called Mynith y Rhoes apperteyninge to the ffreehoulders within the sayd Mannor Penryn, and the sayd Jurors saye that the sayd Alban Stepney payeth yearely to his Majestie the some of two shillings for Tire Gwillim Griffith. And the sayd Alban Stepney paieth yearely to his Majestie for the lands called Klothie Kolchon five pence. The sayd Jurors doe presente that there is one Common called Morva Mawr apperteyninge to fortye howses within Iskoed Moris. And they paye to his Majestic of Commorth, everye third yeare, sixe shillings and eight pence for the same. The sayd ffreehoulders ought to be towle free within all his Majestie’s Domynions by reason of theire hould within the Dutchye of Lancaster.
Item to the xith Artickle, the sayd Jurors saye that there is certaine lands called the Fforrest adioyninge to a place called the Glynn within the parishe of Llangandeirne, and the lymitts and boundaryes of the sayd fforreste as the sayd Jurors hard, lyeth Easteward uppon a brooke there called Carwed. And from that southward, the meares and boundarycs betweene the parishe of Llanelly and Llangindeirne untill it commeth to meet with the parishe of Penbrey. And from thence the meares and boundaryes betweene Penbrey, Llangindei[r]n untill it commeth to the horsewayc leadinge from the howse called Trynsaran to a Bridge lyinge uppon the River of Gwendrath Vawre called the Nwe (sic) Bridge. And from the same northward along the sayd river untill it meeteth with his Majesties lands called Ynys Vawre. And from thence to the sayd river of Carwed. The sayd Jurors saye that they harde that there is one parcell of lands within the parishe of Penbrey which is taken to be parcell of the sayd fforreste commonly called Y Koed Mawre and adioyninge to the sayd fforreste neere the waye above sayd. And the sayd Jurors saye that Wylliam Powell, Esquior, and Margarett his wyfe, as in the righte of the sayd Margarett, houldeth parte of the sayd lands within the sayd fforreste. Henry Dounlee, Esquior, Rowland Lloyd, gent, Lewis Morgan and John Hugh Morgan, hould all the reste of the sayd lands called the fforreste for the which lands there is payd to his Majestie by the sayd Willyam Howell and Margarett his wyfe, Henry Dounlee, Rowland Lloyd, gent., Lewis Morgan and John Hugh, certayne Cheife Rente, the which is payd to his Majesties Beadells of Mannor Cadwgan, Mannor Penryn and Mannor Iskoed Moris, the quantitye of the sayd lands the sayd Jurors doe not knowe.
Item to the xiith Artickle touchinge the encroachments and inclosures that have byne made hearetofore owte of the out of the mountayne, called Mynith Kyvorth, and whither it was knowne by the names of Mynith Ycha, Minith Issa and Mynith Kenoll, and whither the same did not extend from a place called Cwmnant y ffune to a brooke called Cwm y ffroode, and whither Harry Lewis, David Cadwgan, Gryffith Willim Goch, Thomas Lewis of Carmarthen, Thomas John Llewellyn Ddy of Llangaindeirne, Richard Nashe of Carmarthen, Willyam Phillipes of Llangonnor, and Thomas Phillipes his sonne, weare not presented for severall encroachments testified by fowre several witnesses Anno xxxiiii Elizabethe whoe then occupied the same, what quantitye it is and how longe since the same hath byne encroached and inclosed. The sayd Jurors saye that John Lloyd, Richard David Harry and David Willim John nowe Jurors doe affirme unto the reste of the sayd Jurors that the sayd John Lloyd, Richard David Parry and David Willim John weare in a Jury Anno xxxiiii Elizabethe with Richard Jones Esquior, and others then Jurors sworne before John Worthe, gent., deputye to Sir John Points, Knight, then Surveyor of this lordshipp. And that then it was presented amonge other Commons that theare was one Common called Mynith Kyvorth within Mannur Gonnor, which Mynith Kyvorth was then knowen by the names of Mynith Ycha, Mynith Issa and Mynith Kenol, the meares and boundes they doe not remember, And that theare was certayne nwe (sic) enclosures uppon parte of the sayd Mynith Kyvorth made and enclosed by divers persons as by the depositions of certayne witnesses sworne in that behalfe appeared which the sayd Jurors did fynd and presente accordingly. Also it was then presented that one Henry Lewis had neere abowte two and twentye yeares then before paste erected and made one ditche in and uppon the sayd mountayne wherewith he had enclosed one greate Close called Bailey bach. And that then the deposityons of Willim Howell Willim, Willim David John, Redderch David John and Traharne Morgan, sworne and examined concerninge suche enclosures as weare then made and enclosed within theire memorye on the sayd mountayne called Mynith Kyvorth. The sayd John Lloyd, Richard David Parry and David Willim John alsoe affirme to theire remembrance that the depositions of the witnesses weare then written uppon the backe of the sayd presentment, which depositions weare as followeth to theire remembrance, viz., that one Henry Lewis David Cadwgan did enclose one Close called Bayley bach, but the certaine number of acres they did not knowe. And that Gryffith Willim Goche, deceased, did alsoe enclose divers parcells of the sayd waste together with one tenement or dwelling wherein then inhabited one Rees ap Howell. And that Thomas Lewis of Carmarthen had alsoe enclosed one greate close with one tenernent or cottage in and uppon the same. And Thomas John Llewelyn David of Llangandeirne had likewyse enclosed one greate close, the quantitye not certayne. And that Richard Nashe of Carmarthen had alsoe enclosed one greate Close and since divided into two closes. And that Willim Phillipps of Llangonnor, gent, deceased abowte thirtye yeres then before paste, did cause to be enclosed divers closes and parcells of lands which before layed alsoe open with the sayd mountayne. But in some parte of the same lands soe then enclosed theare apeared divers balks and other markes whereby it seemed that parte thereof had byn before plowghed. And that Alban Stepney, Esquior, held three Closes on the north weste parte of the sayd mountayne beinge alsoe enclosed within theire memorye. And the sayd Jurors doe allsoe saye that it was proved before them that theare was one close called Thomas Lewis Lands adioyninge to the sayd mountayne and that the ditche thereof would be sometymes out of reparacouns and sometymes repayred. And one other close adioyninge unto the same which layed open to the mountayne which is made upp by whome they doe not knowe, but theare was a title claymed unto it allwayes. All this Artickle uppon the Informacion aforesayd is presented by the reste of the Jurors.
Item to the xiiitli Artickle, the sayd Jurors saye that they doe not knowe of any lands, leases, or other estats of or in the premysses have byne or are escheated or fforfeyted to his Majestic within the space of three score yeares paste or more by reason of any one attainted for ffelony or for beinge ffelons themselves, or by reason of any one dyinge withowte heire. But the sayd Jurors saye that aboute ffyfteene years laste paste, one David Thomas David Howell of Llangandeirne hanged hymselfe, the sayd Jurors doe not knowe of any lands that he had at the tyme of his death.
Item to the xiiiith and xvth, the sayd Jurors are ignorante and knowe nothinge to be presented.
Item to the xvith, the sayd Jurors saye that the amerciaments and perquisitts of his Majesties Courts within this Commott doe yearely accrwe and growe to the some of Eighte Pownds or there abowts for the space of tenn yeres laste paste and further they are ignorante.
Item to the xviith they sayd Jurors saye that his Majestie hath within theyre chardge, seaven Corne Mylles and that Ffrauncis Maunsell Esquior houldeth fowre of the sayd Mylles, and Willim Powell, Esquior and Margarett his wyfe, the other three mylles, all which are in reparacions.
Item to the xviiith the sayd Jurors saye that theire is one fayre kepte neare the Churche of Llangandeirne uppon the xxvth daye of Julii, and that the Balieffes of the towne of Kydwelly for the yeare beinge are wonte and have used to directe and rule the fayre aforesayd and take and receave the Proffitts thereof, by what right they knowe not, and what it is worthe yearely they are ignorant.
Item to the xixth the sayd Jurors saye that his Majestie is Patron of the Vicarydge of Penbrey and Llandevaylog and of the parishe of Llangandeirne by the name of Chappell annexed to Llandevaylog within this Commotte of Kydwelly, as in the righte of his Highnes sayd Dutchye, as the sayd Jurors doe take it. And that Thomas Prichard, Clerke, is nowe Vickar of Penbrey and Wyllim Phillippe, Clerke, of Llandevaylogg, and Thomas Lloyd, Clerke, Curat of Llangandeirne.
Item to the Twentith, the sayd Jurors saye that there is noe wreks hapned within theire chardge to his Majestie to theire knowledge.

The examynacions of certayne wyttnesses taken before Gerrard Bromley, Esquior, his Majestie’s Survayor of the Possessions of the Dutchye of Lancaster for the South Parts touchinge the late enclosure of the mershie or meadowe by Carmarthen sworne on his Majestie’s beha/fe. Sic dicunt super sacramenta:
Rowland ap Pruther, gent, of the parishe of Llandivaylog at the age of xlvii or theare abowts, sworne and examyned att Kydwelly, the iii daye of October, 1609, sayeth that he did execute the office of debuty Bayly Coroner and Escheator to Sir Thomas Jones, Knight, within the liberty of Kydwelly for the space of xii or xiii yeares. And that duringe the time aforesayd he did execute the office of Coroner uppon the lower ende of the marshe by Carmarthen nowe in questyon uppon the body of one John Peter as hee remembreth which was drowned in the Ryver of Toway and taken upp on the south syde of ye sayd ryver att the lower ende of ye sayd marshe, and theare impannelled a Jury accordinge to the lawe, whoe delivered upp a verdict on the body which remaynes of recorde. Att the same tyme hee sayeth further that before hee would execute his office of Coroner on the place, because hee would be assured it was within his liberty, sente unto the Mayor of Carmarthen named John Ffysher to knowe whether he would execute the office of Coroner in that place or not. Whereuppon the Mayor returned hym answere that hee would not medell with itt, and willed hym to looke unto itt at his perill. Then afterward att a nother tymne hee further sayeth that hee did execute the office of Coroner in like sorte uppon the body of a woman that was drowned in ye sayd Toway and taken upp on the sayd marshe. And further he sayeth that for wayves, strayes and ffelons goods he mente to take them up there, as within the libertye and jurisdiction of the sayd Lordshipp of Kydwelly.
Ffrauncis Lloyd de Glynn, Esquior, sworne and examyned at Trymsaram the viith daye of October 1609, sayeth that after the inclosure of the marshe or meadowe by Carmarthen nowe in questyon, hymselfe, Mr Thomas Phillippes and others beinge together at Carmarthen in Sir John Vaughans howse, whoe was then alsoe presente, they fell in speeche concearninge the sayd marshe. Mr Thomas Phillippes and the sayd Ffrauncis Lloyd spake unto Sir John Vaughan that hee would not be a meanes to take awaye theyre ryghte of Common in ye sayd marshe, whereunto Sir John replyed that he would not, but tould them it was intended to be imployed for the maynetenance of a ffree scoole in Carmarthen which would bee good both for the towne and Contrye, whereuppon the Contry surseased theyre Clayme and pursuite of theyre ryghte thereunto. Then Sir John aleaged the title of the towne which was, as he sayd, that they did paye unto his Majestie a rente of vis. viiid. into his Highnes Exchequor. To which it was replyed by Mr Thomas Phillippes that hee was pryvye unto the practyse howe that rente of vis. viiid. was firste raysed ffor that hee was in place when Mr Water Vaughan, ffather unto the sayd Sir John, did paye the firste vis. viiid. for the sayd marshe unto Mr Robert David then her Majesties Receavor for the Exchequor, ffor as the sayd Thomas Phillippes then reported that the sayd vis. viiid. was dwe uppon some other land within the graunte of the towne on the other syde of the water which was noe parcell of the Dutchye land, called as he remembreth Guerne y Kesech or suche like name. Then it was incerted by Mr Robert David in his acquitance that the sayd vis. viiid. was payd for the sayd Marshe. Then Mr Phillipes sayd that hee tould Mr Water Vaughan that it would redowne muche to his discredyte if the shiftinge of the sayd acqitance should bee knowne. Mr Water Vaughan byd hym hould his peace, itt should be turned to a ffree Schoole.
An abstracke out of the Presentement of the Jurye for the Welshrye of the Commotte of Kydwelly att a Courte of Survaye before John Worthe, Deputy Survayor to Sir John Poynts, knight, the xth daye of October anno Elizabethe xxxiiiio qui juratores inter alia dicunt super Sacramenta viz.,
To the xith Artickle. They alsoe saye that there is within Mannor Gunnor, two severall commons, the one called Mynith Kerig and the other called Mynith Kyvorth. The depositions annexed unto the aforesayd presentemente of William Howell William Wylliam David John Redderch David John and Traharne Morgan, sworne and examined concerninge suche inclosures as have byne made and inclosed within theyre memorye on the Mountayne called Mynith Kyvorth taken before the sayd Jurors as followeth qui dicunt super sacramenta:
That one Henry Lewis David Cadwgan did inclose one Close called Bayly Bach, but the certayne number of acres they knowe not. That Richard Nashe of Carmarthen hath alsoe inclosed one greate close and sythence divyded it into two. That Wyllyam Phillippes of Llangonnor, gent., deceased abowte xxx yeares paste did cause to be inclosed diverse closes and parcells of land which before laye alwayes open with the sayd mountayne but in some parte of the same land soe then inclosed theare appeared diverse balkes and other markes whereby it seemed that parte thereof had byne before ploughed. That abowte xii monthes laste paste Thomas Phillipes, gent., Sonne of the sayd Wylliam Phillipes hath likewyse inclosed two great closes without the grownd soe inclosed by the sayd Wyllyam Phillips, contayninge by estymacion C acres. And that Albone Stepney, Esquior, houldeth 3 closes on the north weste parte of the sayd mountayne beinge alsoe inclosed within there memoryc. They further saye that all ye premysses were possessed together with the sayd mountayne or waste by the inhabitants neare borderinge the same before the sayd severall inclosures.
The examinacions of Sundry personns taken before Gerrard Bromley, Esqujor, his Majesties Survayor, etc. Anno viio Regis Jacobi 1609, touchinge diverse and sundry inclosures out of Mynith Kyvorth qui dicunt Super Sacramenta:
Phillipp Dd Donn de Llangonnor, sworne and Examyned sayth that he knewe Mynith Kyvorth and further that he knewe Mynith Kyvorth Kenall, the Mydle Mountayne, and remembers diverse closes there nowe inclosed to lye open and in Common, and particularly that Henry Lewis David Cadwgan did inclose a greate plotte called Bayley Bache which before laye open in Common. And further he sayeth that hee knewe it Common all there abowte. And further he sayeth that he remembers those closes which Mr Stepney hath inclosed to lye open and in Common. Alsoe he knewe the lands which Thomas Lewis of Carmarthen did inclose lye open and in Common which is nowe in ye occupacion of Mr Stepney. Alsoe he sayeth that he knewe certayne Lands which Richard Nashe of Carmarthen inclosed out of the sayd mountayne which he boughte of Hugh Lloyd lye allsoe open in Common which are nowe in the occupacion of Mr Stepney.
Gryffith Richard of Llangonnor, sworne and examyned, saythe that he hath hard of a close inclosed by Thomas Phillipes gent., out of the sayd mountayne called Mynith Kyvorth and a notber by Sir John Vaughan, but ye particulars he doth not remember, it beinge but xxti yeares since he came to dwell at Llangonnor.
Lewis Dd ap John ap Price of the age of lxxx yeares or theare abowts sworne and examyned before me at Kydwelly, the xxvth of September, 1609, sayeth that he knoweth Mynith Kyvorth by the severall names of Mynith Ycha, Mynith Yssa and Mynith Kenoll. Mynith Ycha which is the hyer mountayne which is in Iskennen, he knewe Dd. Vaughan have a rente for ye same, Mynith Kenoll, the Myddle Mountayne which the Phillippes claymed, he kneweth it lye open with the hyer mountayne in Common. Thomas Phillippes inclosed moste parte of ye Mydle Mountayne and his ffather Wyllyam Phillippes which they claymed. And he further sayth that he knowes the lower mountayne of Mynith Kyvorth called Mynith Yssa, and particularly he remembers the inclosures of those grownds which Mr Stepney hath to lye open likewyse in Common but hath hard that they challenged them by meares and bounds, whereof Richard Nashe inclosed some parte at firste and after Mr Stepney.
Stephen ap Bowen of the age of lxxii or there abowts sworne and examyned before mee in the Castle of Carmarthen the ixth daye of September 1609, sayth that he hath hard that Thomas Phillippes did inclose a greate parte of Mynith Kyvorth. Hee knowes nothinge touchinge the clayme made of it to belonge to the Dounes Lands. Further he sayeth that Mr Stepney hath iii closes which weare inclosed out of Mynith Kyvorth within his memory. Alsoe he sayeth that Mr Doun Lees ffather did inclose certayne grownds which hee thinkes was parcell of the sayd mountayne, all which he remembreth to lye open with the sayd mountayne in Common.
Rice ap Richard of Llangandeirne of the age of lxiii yeares or theare abowts, sworne and examyned before mee att Kidwelly the xxxth of September 1609, sayeth that hee knowes Mynith Kyvorth and that he knewe Mynith Kyvorth Kenoll, that he hath hard and doth thinke that Mr Phillippes did inclose some parte out of the sayd Mynith Kyvorth Kenoll. And further he sayeth that he doth remember that Sir John Vaughan did inclose that parte which was called Mynith Ycha. And, further he doth remember that Richard Nashe did make the first ditche and inclosure out of the lower mountayne which afterward Mr Stepney inclosed and hath now in his occupacion. He hath hard likewyse that the close which Mr Stepney hath betweene the close of John Llewelyn Achan and ye close that Nashe inclosed was inclosed by Thomas Lewis out of Mynith Kyvorth. All which inclosures he remembers lye open in Common.
Gryffith John Phillip Powell of the age of lviii yeares or there abowts, sworne and examyned before mee at Kydwelly the xxxth of September 1609, sayeth that he knoweth Mynith Kyvorth by Mr Stepneys and Mr Doun Lees, he remembers since iii of Mr Stepneys closes weare firste inclosed, viz., that which Richard Nashe inclosed and that alsoe which Thomas Lewis inclosed. But sayeth that they had some to keepe the cattell from commynge into them. Also he remembers the firste enclosure of that which Mr Doun Lees ffather inclosed by Combe y ffrowd, that he hymselfe did helpe to mend the sayd inclosure. But he hath hard they claymed it by the Meare of a Stone as belonginge to the Doune Lands.
Stephen ap Bowen, sworne and examyned before mee in the Castle of Carmarthen the ixth daye of September, 1609, sayeth that the Marshe inclosed by Carmarthen and nowe in questyon was alwayes during his memorye held as a Common belonginge to Kydwelly. And that it was ever reputed and taken as parte and parcell of the sayd Lordshipp of Kydwelly. That the Tythe of the sayd Marshe was allwayes payd to the Churche of Llangonnor. That the Baylyfe of the Libertyc did allwayes, when occasyon was, execute his office by arestinge etc. as allsoe the office of Coroner.

It apeareth by antient Recordes that ye tenants of ye 3 Commotes of Kedwelly did before ye tyme of King Henry 8 alwayes take theyr lands by the Rodde of ye Steward in Courte and that whensoever any tenant would alien parte of his lands or ye whole he must doe it by surrender in Courte and delyver seazon by ye Rodde and payed a fine to ye Lord viz., for alienation of parte vs., for ye whole xs. Upon the death of any tenant ye eldest sonne payd id. and every younger sonne vs. and tooke theyr lands of ye Steward by ye rodde in Courte. Since which tyme of King Henry 8, this manner of taking by ye rodde hath bin neglected and now every man passeth his lands by deede and Release among themselves, by meanes whereof ye King hath lost a fyne upon alienacion of parte, and many other fraudes are happened by it. How this tenure bath bin altered aperereth nott, nor upon what grownde for proofe that the tenants did houlde by ye rodde. It appeared to me both by Recordes I have perused, and by the testimony of aged men within your Lordship upon their oathes during ye survay I tooke theare anno 1609, viZ., ut sequitur:
The examynacon of Dd. ap Jeuan Gwalter of Llaneddy taken ye 13th day of September 1609:
Dd ap Jeuan Gwalter of Llaneddy, sworne and examyned, of ye age of 88 yeares or thereabouts, sayth that he doth remember ye tyme when ye Rodde was used, and that ye tenants did take theyr lands of ye steward by ye Rodde in Courte, butt any particular men that tooke by Ye Rodde he doth nott remember because he was very young then and as he remembreth hymselfe did take his lands by ye Rodde, that ye eldest sonne did pay id. upon his taking by ye Rodde and every yonger sonne vs. He hath likewise heard that upon every surrender of parte or alienacion they payd vs. for a fine besydes a heriott, and xs. when any soulde all his lands, which was called a Gwaglough, which he affirmeth was ye common and credible reporte in antient tyme.
Dd ap Jeuan David Gwalter of Llaneddy, age of 68 or thereabouts, sworne and examyned, sayeth that he hath heard say credibly that the tenants did use ye rodde, butt it was before his remembrance. And that ye eldest sonns did pay id and ye rest vs. upon ye death of their ancestor. And that upon every surrender and Alienacion, they did pay vs. butt upon Alienacion of all they did pay xs. for a Gwaglough.
Ellin Joan Morris of Llangenech, age of 80 yeares and upwards, sworne and examyned, sayth that she did take by ye Rodde herselfe, that her father did delyver her seazon and possession of ye tenement she now hath by ye Rodde att ye hands of ye Stuarde in Court, when she was very yonge of ye age of 7 yeares or thereabouts, that she continues ye possession of her said tenement called Tai penny towen neare ye church of Llangenech, by vertue of ye sayd seazon, delivered her by her father, unto this day without any alteracion of ye said estate.
Stephen ap Bowen age of 72 yeares or thereabouts, borne att Llanganderne, sworne and examyned, sayth that the tenants of ye 3 Commotes did surrender and take theyr lands by ye Rodde in ye Lords Courte by the hands of the Stewarde, as he hymselfe hath seene by divers Recordes. The eldest sonne did alwayes pay id. and every other yonger sonne vs. upon an admittance after the death of his Ancestor. And upon every surrender and Alienacion, they did pay vs. but upon Alienacoun of all xs. in ye name of a Gwaglough, besydes a heriott.
